EdZapp.com is a service operated by EducatorZapp, Inc.; for convenience, we will refer to our company and services synonymously as EdZapp. These are the conditions of the Subscription Agreement between you, the Subscriber and EdZapp. Which manages the product and services provided to you:

1. Our Responsibilities. We agree to allow you to select a username and password in order to allow you to access our services
2. Your Responsibilities. A subscription is subject to your agreement to the Terms and Conditions set forth in this User Agreement. By registering as a subscriber, you warrant that you have the authority to agree to, and that you have read, understood and will be bound by, these Terms and Conditions. You are responsible for maintaining the secrecy of your username and password, insofar as you are reasonably able to do so. You agree to notify us of any unauthorized use, and to change your password if secrecy is compromised.
3. Term and Fees. For paid subscriptions, the Subscription shall commence on the date your payment is received by us and shall continue for length of one year. Free subscriptions are made "invisible" to districts after 60 days of inactivity, and expire after one year. We reserve the right to suspend and/or terminate this Subscription Agreement without prior notice if we believe that you have violated any term of this License Agreement.
4. Use of the Content. The Content may be accessed, viewed or otherwise used only by you and participating school districts. You are only permitted view and/or browse the Content, and/or make limited copies of portions of the Content as fall within the "fair use" provisions of the United States Copyright Act, provided all such uses are for noncommercial personal purposes. You are not, however, permitted to retrieve and store in electronic or any other form any of the databases underlying the Content that is accessed through our Website. All commercial use of the Content of any kind, including reproduction of any kind for a commercial purpose of any kind, direct or indirect, is strictly prohibited. The Content, the Website remains solely our property or the property of our content providers at all times.
5. Acceptable Use of Services. EdZapp provides applicant services to store personal and professional information for users with the intent to seek employment from member and/or nonmember school districts. You are responsible for using the EdZapp services with lawful intentions and to provide accurate information whenever required.
6. Technical Support. We will provide you with e-mail and web-based technical support for the term of the Subscription Agreement.
7. Use of Personal Information. We undertake not to sell, rent or lease any personally identifiable information concerning you and to use such information solely for the administration of your account with us. We may send you e-mails in connection with the administration of your account and with other information, but only if you have agreed to receive such e-mails. In accordance with our Privacy Policy, viewable here, we may disclose from time to time non-personally identifiable data in aggregate form.
8. Modification of Terms and Conditions. We reserve the right to change, modify, suspend or discontinue at any time any and all of the Content provided through our Website. We also reserve the authority to modify, suspend or discontinue any and all terms of this Subscription Agreement at any time without notice.
9. Fees. EdZapp may charge users for certain services and features of the program. Fees may be instituted, changed, reassigned, retracted, or waived with or without notice at the sole discretion of EdZapp.
10. Refund Policy. EdZapp will refund subscription payments under reasonable circumstances, upon request, within 48 hours of the transaction. Refund requests after 48 hours must be submitted via email to support@edzapp.com, stating the reason(s) and conditions supporting the request. We reserve the right to refuse any refund request for any reason, or to refund only a portion of the requested refund amount.
11. Disclaimer. Access to the Content and use of the website is provided without warranties of any kind. Although all content is believed to be reliable, we do not guarantee the reliability, accuracy, completeness, timeliness, legality or usefulness of any content. Additionally, service availability is subject to maintenance downtime and circumstances beyond our control.
12. Limitation of Liability. EdZapp is just a conduit and all transactions are between the applicant and the school districts. You agree not to hold EdZapp liable for the outcome of any application for employment with any EdZapp registered employer. You shall hold harmless EdZapp from and against any costs, losses, liabilities and expenses that EdZapp may incur by reason of any legal action, proceeding, arbitration or other claim by a third party arising out of or as a result of any action taken by you.
13. General. This Subscription Agreement constitutes the entire agreement between us concerning access to the Content and supersedes any prior communication, whether written or oral, with respect to access to the Content. Your use of the Software and the Web Site is governed by the license agreement to which you agreed. You can file and print this Agreement by copying and pasting it into a text or word processing document.

By registering as an EdZapp subscriber, you indicate your agreement to the terms and conditions of this Subscription Agreement and your acceptance of this electronic agreement as a valid and binding contract.
